This includes access credentials, passwords, and sensitive information provided by our clients, which are managed under strict confidentiality and security protocols.

3. Confidentiality of Access Credentials and Sensitive Data

We deeply respect the confidentiality of the information provided by our clients. This includes, but is not limited to:

  • Platform access credentials, passwords, administrative permissions, technical files, or internal information.

All such information is managed privately, securely, and exclusively, with access limited only to authorized personnel and solely for the purpose of delivering the contracted services.

We never share, transfer, or use this information for external or commercial purposes.


4. Data Sharing with Third Parties

Your information may be shared, only when necessary, with:

  • Technology platforms such as Meta, Google, CRM providers, or email marketing services.

  • Technical service providers operating under confidentiality agreements.

We never sell or rent your personal data to third parties.


5. Use of Cookies and Similar Technologies

Specific Service Policies

1. Web Development

1.1 Scope of Service

The web development service includes the creation, configuration, and implementation of a website or digital system according to the scope, functions, structure, and design stipulated in the contract signed with the client.

1.2 Third-Party Licenses

Development may include plugins, themes, or tools with commercial licenses. Unless otherwise agreed in writing, the purchase, renewal, and maintenance of these licenses shall be the client’s responsibility.

Isaac Jacob may use temporary licenses during the development process, which must be replaced with the client’s own licenses if the client wishes to retain the functionality.

1.3 Testing Environment and Delivery Conditions

All development is initially carried out on a staging server managed by Isaac Jacob Image & Technology. This environment allows the client to review project progress, provide feedback, and approve the final result prior to release.

The website or system will not be migrated to the client’s production environment nor published definitively until 100% of the agreed payment has been received. This policy protects the final process and ensures compliance with the agreed commercial terms.

1.4 Exclusions

Web development does not include ongoing maintenance services, post-delivery support, content writing, additional graphic design, advanced animations, SEO optimization, or integration with external tools, unless explicitly detailed in the contract.


2. Website Maintenance

2.1 Preventive Maintenance Recommendation

Isaac Jacob Image & Technology recommends periodic maintenance (monthly or bi-monthly) to ensure the proper functioning, security, and stability of developed websites.

This maintenance includes system updates (e.g., WordPress), plugins, themes, security reviews, backups, and general monitoring of site status.

2.2 Limitation of Liability for Lack of Maintenance

If the client fails to perform the recommended maintenance actions or ignores alerts, visible errors, or reported technical warnings, Isaac Jacob Image & Technology shall not be responsible for the consequences of such omission, including but not limited to:

  • Hacking or unauthorized access

  • Partial or total loss of information

  • Plugin incompatibilities or failed updates

  • Website downtime or operational errors

Any corrective or recovery intervention resulting from lack of maintenance shall be considered an independent technical service and may be billed hourly or under a previously agreed plan, depending on the scope of the issue and required work.


3. Digital Business Consulting

3.1 Service Objective

This service is designed to analyze the company’s internal processes and propose strategic technological solutions to optimize operations, communication, efficiency, and decision-making.

3.2 Scope

Consulting includes diagnostic sessions, identification of opportunities, strategic recommendations, tool selection, automation proposals, and guidance for technological implementation.

It does not include direct technical execution unless a complementary project is contracted.

3.3 Contracting Model

Consulting may be contracted on an hourly basis or through a retainer/hour package model, depending on the client’s needs and the type of support required. Both models will be quoted in advance and detailed in the commercial proposal.

3.4 Limitations

Recommendations are based on validated methodologies, reliable tools, and professional experience. However, effective implementation also depends on the client’s internal commitment and organizational structure.


4. Automations and Technological Solutions

4.1 Scope of Service

Includes the design, configuration, and integration of tools such as CRM, ERP, bots, automated workflows, dashboards, internal management systems, or other custom solutions, according to the previously agreed scope.

4.2 Client Responsibility

The client must provide appropriate and timely access to the involved platforms, maintain active accounts and required licenses, and actively collaborate during testing, validation, and deployment.

4.3 Updates and Post-Delivery Maintenance

Once the project is completed and delivered, Isaac Jacob Image & Technology assumes no responsibility for ongoing maintenance or updates unless a specific maintenance service has been contracted.

All technological systems require continuous updates to function properly. If the client fails to update platforms, extensions, APIs, or integrated components, we shall not be responsible for errors, misconfigurations, loss of functionality, or operational failures that may arise over time.

Any adjustments, modifications, or interventions after project delivery shall be considered a new technical service and will incur additional costs based on the scope of the requested change.

4.4 Exclusions

The service does not include continuous support on third-party platforms, future integration of new tools, extended training of internal teams, or support outside agreed business hours, unless otherwise specified in the contract.


5. Digital Marketing

5.1 Scope of Service

The scope of digital marketing services is determined by the plan contracted by the client, which details included services, execution frequency, deliverables, and advertising channels involved. Any service not included in the plan must be quoted and approved separately.

5.2 Recommended Continuity for Results

For new digital marketing services, Isaac Jacob Image & Technology recommends a minimum continuity period of six (6) months. This allows testing, optimization, metric analysis, progressive improvement, and market adaptation. Without this period, results may not reflect the full potential of the applied strategy.

5.3 Payment Methods and Platforms

Isaac Jacob Image & Technology does not make advertising payments on behalf of the client to platforms such as Meta Ads, Google Ads, TikTok Ads, or similar services.

The client must maintain their own advertising accounts and assume direct responsibility for advertising budgets. Our team will manage campaigns only with authorized access to those accounts.

5.4 Shared Responsibility and Metrics Tracking

To properly evaluate campaign performance and make data-driven decisions, the client agrees to track incoming leads and sales generated through activated channels.

If the client does not have tracking tools or fails to provide clear and periodic data, Isaac Jacob Image & Technology cannot assume responsibility for measuring business growth. Marketing success requires joint commitment.

5.5 Results and Metrics

Campaign results may be influenced by multiple factors including budget, target audience, seasonality, product/service quality, competition, and market conditions.

Therefore, Isaac Jacob Image & Technology does not guarantee specific results such as leads, sales, or engagement but commits to applying strategies based on data, experience, and industry best practices.

5.6 Usage Rights

Designs, texts, and materials created during the service shall be the property of the client, exclusively for use within their brand and contracted channels. They may not be resold or reused by third parties without prior authorization.


6. Corporate Identity / Branding

6.1 Scope of Service

This service includes the design or redesign of visual identity elements such as logos, symbols, color palettes, typography, brand guidelines, visual assets for digital and print media, and corporate applications.

6.2 Review and Approval of Final Artwork

All designs developed will be submitted to the client for review prior to final delivery. It is the client’s responsibility to thoroughly review each design and provide written approval (email or confirmed message) before final delivery.

Once formal approval is granted, Isaac Jacob Image & Technology shall not be responsible for errors, omissions, incorrect text, or technical issues identified later, especially if materials have already been printed or distributed.

6.3 Print Design and Provided Measurements

For print materials (flyers, packaging, signage, banners, labels, etc.), the client is responsible for providing accurate measurements and technical specifications (bleeds, margins, formats, printer requirements).

We shall not be responsible for production errors resulting from incorrect, incomplete, or later-modified specifications. If the client requests direct communication with their printer or supplier, this service must be requested and quoted separately.

6.4 Exclusions

The branding service does not include physical printing or editable source files unless previously agreed in writing.

Standard deliverables are provided in high-quality formats (.JPG, .PDF, .PNG, .EPS) suitable for digital use or printing as required.

6.5 Intellectual Property and Delivery Conditions

All designs become the property of the client once full payment has been received.

Final materials (high-resolution files, exported versions, adaptations for print or digital use) will not be delivered until 100% of the agreed amount has been paid.

Any use of materials before full payment or without express authorization constitutes a violation of copyright and intellectual property rights.

6.6 Third-Party Elements

When third-party images, fonts, or illustrations are used, the client must ensure appropriate commercial licenses are obtained. Isaac Jacob may recommend stock resources, but legal acquisition remains the client’s responsibility unless otherwise agreed in writing.

Any phone call or video call conducted with Isaac Jacob Image & Technology may be recorded for quality control, project tracking, and customer service improvement purposes.

Information shared during such calls — including personal, technical, or business data — will be treated with strict confidentiality and used solely for legitimate purposes related to the provision of our services.

We commit not to disclose, transfer, or use the information for purposes other than those agreed upon, unless expressly authorized by the client or required by law.

By continuing with the call, you acknowledge and accept this confidentiality notice and the responsible processing of your information in accordance with our privacy and data protection policies.

 


I. GENERAL PROVISIONS

1. Acceptance of the Terms

By contracting any of the services offered by Isaac Jacob Image & Technology, the client declares that they have read, understood, and fully accepted these Terms and Conditions, which form an integral part of any proposal, quotation, Project Chart, or signed contract.

Acceptance may occur through:

  • Physical or electronic signature

  • Written confirmation by email

  • Digital approval message

  • Initial payment

  • Continued use of the services

These terms also apply to projects initiated prior to the date of this update, provided the client continues to use services, implemented platforms, automations, managed licenses, or post-delivery support.

Continued use constitutes express acceptance of these updated terms.


2. Jurisdiction and Governing Law

This document is governed by the laws of the Republic of Costa Rica.

Any dispute shall be resolved before the competent courts of Costa Rica, unless the parties agree to an alternative dispute resolution mechanism.


3. Modifications

Isaac Jacob Image & Technology reserves the right to modify these Terms at any time.
Modifications shall become effective upon publication on the official website.


II. CONTRACTUAL STRUCTURE AND PROJECT CHART

Each project shall be executed in accordance with the Project Chart or scope document accepted by the client through written confirmation.

Written acceptance constitutes a formal commitment to execute the defined scope.

Any work not expressly included shall be quoted separately.

Delivery timelines may be affected if the client fails to provide required information, access, content, or approvals within the agreed timeframe. In such cases, the schedule will be automatically rescheduled.


III. PAYMENTS AND NON-REFUND POLICY

Payments made for:

  • Consulting

  • Web development

  • Automations

  • CRM or ERP implementation

  • Branding and corporate identity

  • Strategic planning

  • Digital marketing

Are non-refundable once the service has begun.


IV. PROJECT ABANDONMENT OR SUSPENSION

If the client suspends the project for more than 30 consecutive days without providing required information or formal communication, the project may be considered suspended.

To reactivate the project:

The client must pay 80% of the outstanding balance.
The remaining 20% shall be paid upon formal resumption of the project.

Reactivation may require schedule adjustments and additional costs.


V. EXTERNAL LICENSES AND TECHNOLOGY PROVIDERS

Isaac Jacob Image & Technology acts as an authorized partner and commercial intermediary for platforms such as Kommo CRM, Odoo, Clientify, or other technology providers.

We are not the owners of the software and do not control:

  • Internal policies

  • Infrastructure

  • Price changes

  • Removal of free plans

  • License modifications

  • Account suspensions

  • Data deletion

Licenses are invoiced as an intermediary.

We do not issue refunds for licenses.
Any refund request shall be subject exclusively to the policies of the external provider.

The client is the legal account holder and responsible for timely renewal.

Failure to renew may result in suspension or permanent deletion of data according to provider policies.


VI. APIs, META, WHATSAPP, AND ACCOUNT BLOCKS

Meta Platforms Inc., WhatsApp LLC, and affiliated companies are independent entities and have no corporate relationship with Isaac Jacob Image & Technology.

We are not responsible for:

  • Phone number blocks

  • Business account suspensions

  • API restrictions

  • Integration deactivations

  • Changes in WhatsApp policies

  • Unilateral decisions made by Meta

Suspensions may result from internal policies, prior number history, or non-public criteria.

The client is responsible for proper usage and compliance with platform policies.


VII. AUTOMATIONS AND TECHNOLOGICAL RISK

All technological solutions involve inherent risks related to:

  • Cybersecurity

  • API changes

  • External platform updates

  • Third-party decisions

Isaac Jacob does not guarantee perpetual compatibility with external services that may modify their technical conditions.

We do not guarantee uninterrupted operation if third parties modify their infrastructure.


VIII. WEB DEVELOPMENT

Includes only what is expressly stipulated in the contract or Project Chart.

Does not include:

  • Post-delivery maintenance

  • Advanced SEO

  • Unagreed integrations

  • Additional design work

  • PDF creation

  • Unestimated functionalities

The website will not be published until 100% payment has been received.


IX. WEBSITE MAINTENANCE

Maintenance is recommended.

If the client fails to perform maintenance:

We are not responsible for hacking, malware, data loss, incompatibilities, or system downtime.

Recovery services will be treated as additional services.


X. DIGITAL BUSINESS CONSULTING

Includes diagnostics and strategic recommendations.

Implementation depends on the client’s internal commitment.

We do not guarantee results derived from the client’s internal execution.


XI. DIGITAL MARKETING

We do not guarantee specific results such as sales, leads, or engagement.

The client must track metrics and sales.

We do not make advertising payments on behalf of the client.

Results depend on multiple external factors.


XII. CORPORATE IDENTITY / BRANDING

Designs will be submitted for review.

Once approved, we are not responsible for errors identified later.

Printing services are not included.

Intellectual property transfers upon full payment.

Methodologies, internal processes, frameworks, and strategic structures remain the exclusive property of Isaac Jacob Image & Technology.


XIII. GENERAL LIMITATION OF LIABILITY

Isaac Jacob Image & Technology shall not be liable for:

  • Indirect damages

  • Loss of income

  • Loss of profits

  • Business interruption

  • Commercial losses

  • Data loss caused by third parties

  • External server failures

  • Changes in digital platform policies

  • Force majeure events

Maximum liability, if direct and proven, shall be limited to the amount effectively paid by the client for the specific service that gave rise to the claim.


XIV. PORTFOLIO USE

Isaac Jacob Image & Technology may display completed projects in its professional portfolio, social media, or marketing materials, unless a specific confidentiality agreement states otherwise.


XV. PRIVACY AND DATA PROTECTION POLICY

We process personal data in accordance with Law No. 8968 of Costa Rica.

We collect information when you:

  • Visit our website

  • Complete forms

  • Contact us through social media

  • Interact with campaigns

We use information to:

  • Provide consulting

  • Execute projects

  • Improve digital experience

  • Automate processes

We do not sell or rent data.

We apply technical and administrative security measures.

XVI. CONFIDENTIALITY AND CALLS
